Terms and Conditions

Effective Date: October 2026 | Last Updated: October 2026

These Terms and Conditions ("Terms") form a legally binding contract between you (either as an individual clinic operator, medical practitioner, receptionist, or patient) and PatientCare App ("we," "us," or "our") concerning your use of the PatientCare platform, mobile applications, and WhatsApp booking interfaces.

BY ACCESSING OR USING THE APPLICATION, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DISAGREE, YOU ARE PROHIBITED FROM USING THE APPLICATION.

1. Nature of the Service & Medical Disclaimer

PatientCare is a software-as-a-service (SaaS) workflow, appointment scheduling, queuing, and practice management tool. PatientCare is NOT a licensed healthcare provider and does NOT practice medicine.

Medical evaluations, prescriptions, differential diagnoses, and treatments rendered through the application are the exclusive professional responsibility of the attending doctor. We bear no liability for clinical malpractice or misdiagnosis.

2. Intellectual Property Rights

Unless explicitly designated otherwise, the PatientCare platform, brand assets, proprietary queuing algorithms, interfaces, and codebases are exclusively owned by PatientCare App. Clinics retain complete, unfettered ownership of their private patient rosters and diagnostic logs.

3. User Accounts & Clinical Governance

  • Practitioners must maintain valid licensing with respective medical authorities (such as PMDC).
  • Users must maintain credential confidentiality. Sharing receptionist master keys across unauthorized third parties is prohibited.
  • Accounts suspected of generating fraudulent consultation tokens or unauthorized pharmacy scripts are subject to immediate termination.

4. WhatsApp & Platform Integration Guidelines

Clinic WhatsApp integration is deployed via the official Meta WhatsApp Cloud API. Clinics covenant not to use their verified PatientCare channel for spam messaging, cold solicitation, or non-medical advertisements in violation of Meta Commerce Policies.

5. Subscriptions, Fees & Settlement Splits

  • Software Fees: Flat monthly/annual subscriptions billed in PKR as per chosen tier. Zero per-patient commission.
  • Fee Splits: The clinic owner is solely responsible for defining doctor vs. clinic revenue split ratios within the system.
  • Third-Party Gateway Fees: JazzCash, EasyPaisa, or card processing interchange fees are deducted per processor tariffs.

6. Mobile App Store Licensing (Apple & Google)

Our mobile application distributions adhere strictly to the Apple App Store Review Guidelines and Google Play Developer Program Policies. Apple and Google maintain third-party beneficiary rights to enforce software license covenants against non-compliant users.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PATIENTCARE APP, ITS DIRECTORS, OR DEVELOPERS BE LIABLE FOR ANY CONSEQUENTIAL, INDIRECT, INCIDENTAL, OR PUNITIVE DAMAGES, NOR FOR CLINICAL OUTCOMES, OPD SERVICE INTERRUPTIONS, OR DATA DISRUPTIONS ARISING FROM THIRD-PARTY INTERNET DOWNTIME.

8. Governing Law & Dispute Jurisdiction

These Terms and any dispute arising from the use of PatientCare are governed by and construed according to the laws of the Islamic Republic of Pakistan. Any legal actions shall be submitted to the exclusive jurisdiction of the competent courts in Karachi, Sindh.
